I hereby agree to release the above mentioned software to Cruhaven Productions to sell at the above price, or at a price deemed reasonable by Cruhaven Productions. Cruhaven Productions will make every attempt to satisfy the Programmer with the pricing, but cannot guarantee the selling price. With this agreement, Cruhaven Productions will give for each sale of the software package a 25% royalty fee to the Programmer on the 15th of each month, and to award One Credit Point for each sale of the above software piece. Cruhaven Productions reserves the right to discontinue any software sale due to any contractual disagreements and/or infringements on any other software package. Cruhaven Productions reserves exclusive rights to sell and market the software package submitted which shall include but is not limited to using the name of the package, the Programmer, and any other information deemed relevant to the selling of the software package. Cruhaven Productions has the right to modify the program to fix errors in programming, and can at any time request the source code if the software package is compiled. The Programmer is responsible for telling Cruhaven Productions of any changes they make to the above software package, offer documentation for operating the software package, and to include the machines that it is compatible with and what operating system it is run under. Cruhaven Productions is not liable for programming errors, intentional or otherwise. Cruhaven Productions shall not be liable for copyright infringements made knowingly or otherwise on the above mentioned software package. The Programmer may at any time cancel this agreement with 60 days written notice by registered mail along with the Cancellation Agreement. If the Programmer so chooses to cancel this agreement, the Programmer's account will be closed, any royalties due will be paid on the 15th of the following month, and the Programmer will forfeit any accrued Credit Points. Cruhaven Productions will then return the submitted software package to the Programmer with submitted documentation and/or source code via registered mail. Cruhaven Productions will not be liable for any damage to the software, documentation and/or source code. The Programmer assumes all risks including Acts of God as to the integrity of the software and documentation. Cruhaven Productions reserves the right to edit, reproduce electronically or manually the submitted documentation to meet Cruhaven Productions' standards of quality. Cruhaven Productions can at any time cancel this agreement without the consent of the Programmer. If Cruhaven Productions so chooses to cancel this agreement, all royalties due will be paid on the 15th of the following month, the account will be closed and the Programmer will have 30 days to redeem the accrued Credit Points, if after the 30 day grace period nothing has been done, the Programmer will then forfeit all Credit Points. Cruhaven Productions will then return all materials submitted to the Programmer via registered mail. This agreement will go into effect imediately.
